Terms of Service
Last updated: 13 October 2026
These terms cover work commissioned from Talon Forge LLC. They are written to be read once and understood. Where they say you own something, they mean it.
What these terms cover
They apply to custom app builds and website builds commissioned through this site, and to the optional managed care plan. They also apply to use of this website.
Where an individual project agreement we sign with you says something different from these terms, that agreement wins for that project.
Quotes and scope
Every project starts with a written scope: what will be built, on which platforms, and for a fixed published price.
If you ask for something outside that scope, we will say so before starting it and quote for it separately. If you would rather not pay for it, the original price does not change.
A published price is a price for the scope as written. It is not a discount off an unknown larger number, and it does not rise later.
Deposits, invoices and refunds
Booking a project takes a deposit of 30% of the project price. The balance is invoiced when the agreed stage is delivered.
If we do not deliver work you have paid for, the deposit is refundable and we will refund it.
If you cancel after we have started and before delivery, the deposit covers work already performed and is not refundable. We will tell you when we consider that work to have begun — usually when we begin the build stage — so you always know what you are keeping.
The managed care plan is a month-to-month subscription. Cancel it whenever you like and the site, the domain and all access stay yours.
Timelines
We publish build durations because you need to plan, not because they are guarantees. They assume prompt feedback from you.
Most delays we see come from one thing: waiting on content, access or approvals. We will tell you the moment something is blocked on you rather than quietly carrying the delay.
Your responsibilities
You confirm that anything you give us — text, photos, video, logos, reviews, documents — is yours to give, or that you have permission to use it. This matters more than it sounds: republished Google reviews and social images can carry rights the business does not own outright.
You give feedback in a reasonable time, and you nominate one person who can make decisions. Projects stall when approvals bounce between several people.
We do not publish invented testimonials, ratings or client counts. If we quote a review, it is a real one you are entitled to republish. If you ask us to pad a page with quotes, we will decline that part.
What you own
On final payment you own the source code we wrote for you, and the design assets and documentation produced for your project.
During the project we may need to keep a copy of the working repository in order to deliver it to you. That copy is used to deliver your project and for nothing else.
You do not own our pre-existing tools, internal libraries, or the general knowledge in our team, and we do not ask for them.
If we suggest a third-party service or asset, it remains subject to that provider's own licence and is yours to maintain.
Hosting, domains and the care plan
New sites are delivered on a subdomain under talonforge.xyz. It is live immediately and costs you nothing.
A subdomain is a weaker search position than a domain of your own, because search engines read it as part of ours. When you want your own domain — now or later — we connect it and point it across at no charge. Moving is free.
The managed care plan is 15% of the build price per month and covers hosting, uptime, TLS renewals, security patches and a small number of content changes.
Acceptance and testing
You see working screens before a stage is finished, and you have a reasonable opportunity to ask for changes to what you were shown.
A stage is accepted when you confirm it in writing or when you use it live for ten business days without raising a blocking problem. We ask for acceptance because an unstated 'not quite right' can be argued for a year, and that helps nobody.
Warranties
We warrant that the work will materially do what the agreed scope says it does, and that we will fix defects in it reported within the fix window included in your tier.
We do not warrant that a third-party platform will not change, that a search engine will rank you, or that a particular business result will follow. Anyone who guarantees rankings is selling you something.
Limitation of liability
To the fullest extent the law allows, our total liability to you arising from a project is limited to the amount you have paid us for that project.
We are not liable for indirect or consequential loss, including lost profit, lost revenue or lost data, even where we were told such loss was possible.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Independent contractor
Talon Forge LLC is an independent business. We are not your employee, agent, partner or joint venturer, and you cannot bind us.
Term, suspension and ending
These terms apply from the first contact until a project ends or is cancelled. The care plan continues month to month until cancelled.
We may suspend or end a project if you ask us to do something unlawful, or if a payment is seriously overdue and unresolved after we have written to you about it. Where the situation allows, we will fix it rather than end the project.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. That choice is deliberate: it is the law of the entity you are contracting with.
Before litigation, both of us will try to resolve the dispute directly. Most disputes at this size of business are misunderstandings about scope, and scope disputes are settled by talking.
Nothing prevents either of you from exercising rights you have under the mandatory consumer law of your own country — including rights that cannot lawfully be waived.
Changes to these terms
We may update these terms. The version that applies to your project is the one that was live when that project was commissioned, so an update never moves the ground under something you have already agreed.
Questions first, please
If something here is unclear, ask before you sign. A clause you have not understood is worth more caught now than later.
